Welcome to BuyThisFile! These Terms of Service ("Terms") govern your use of our website and peer-to-peer file monetization service (the "Service"). By using our Service, you agree to these Terms in full. If you disagree with any part of these Terms, you must not use our Service.

1. Our Service

BuyThisFile is a platform that allows users to monetize digital files.

  • Sellers can upload a file, set a price in Bitcoin, and receive a unique link.
  • Buyers can use the link to purchase and download the file by paying the specified Bitcoin amount directly to the seller's provided wallet address.
  • Our role is to provide the technical infrastructure to facilitate this P2P transaction. We are not a party to any transaction and do not take custody of user funds or files.
  • All files are ephemeral and automatically deleted from our servers after a user-specified expiration period (ranging from 4 hours to 1 year).
  • Buyer Protection: For files that have been purchased, we retain the file for a short grace period after the official expiration time (10% of the original duration, up to a maximum of 1 week) to ensure buyers have sufficient time to complete their download.

2. User Responsibilities & Prohibited Conduct

You are solely responsible for your conduct and any content you upload or share through the Service. By using BuyThisFile, you agree not to:

  • Upload, share, or sell any content that is illegal, including but not limited to material that is fraudulent, defamatory, obscene, or promotes hate speech.
  • Share content that infringes on any third party's intellectual property rights, including copyright, trademark, or trade secrets.
  • Distribute malware, viruses, or any other malicious code. We block certain executable file types (e.g., .exe, .bat, .sh, .cmd, .com, .pif, .scr) for security.
  • Use the Service for any money laundering or other illicit financial activities.

You represent and warrant that you have all necessary rights, licenses, and permissions for any content you upload and sell.

3. Payment, Fees, and Transactions

Our Service exclusively uses Bitcoin. You acknowledge and agree to the following terms:

Irreversibility

All Bitcoin transactions are final and irreversible once confirmed on the blockchain. WE CANNOT AND DO NOT OFFER REFUNDS, CHARGEBACKS, OR CANCELLATIONS.

Volatility Risk

Cryptocurrency values are volatile. The price displayed at the time of purchase is an estimate. You accept all risks associated with price fluctuations that may occur during the transaction confirmation period.

User Responsibility

You are solely responsible for the accuracy of the Bitcoin wallet addresses you provide. Transactions sent to incorrect addresses cannot be recovered.

Network Fees & Confirmation

All transactions are subject to Bitcoin network fees, which you are responsible for paying. File access is granted only after a specific number of blockchain confirmations, which varies based on transaction value and network congestion. We are not responsible for any delays.

Confirmation Policy (Risk-Based):

  • $0-$100: 1 confirmation for download access (10 minutes), 3 confirmations for settlement (30 minutes)
  • $100-$1,000: 3 confirmations for download access (30 minutes), 6 confirmations for settlement (1 hour)
  • $1,000+: 6 confirmations for download and settlement (~1 hour)

Payment Session Timeout: 1 hour from payment initiation.

Purchase Availability

To ensure successful delivery, new purchase sessions cannot be initiated if a file is within 10 minutes of its expiration time.

Commission

We take a commission from each transaction as a fee for providing the Service:

  • $0-$50: 5% commission
  • $50-$500: 3% commission
  • $500+: 2% commission

Transaction Limits:

  • Minimum: $10 USD equivalent in Bitcoin
  • Maximum: $10,000,000 USD equivalent in Bitcoin

4. Copyright and Content Takedown

We respect intellectual property rights. While we do not pre-screen content, we will respond to clear notices of alleged copyright infringement.

If you believe your copyright has been infringed, please send a takedown notice to dmca@buythisfile.com containing:

  1. A description of the copyrighted work.
  2. The specific BuyThisFile link where the infringing material is located.
  3. Your contact information.
  4. A statement that you have a good faith belief that the use is not authorized by the copyright owner.
  5. A statement, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
  6. Your physical or electronic signature.

We will act expeditiously to remove or disable access to infringing material upon receipt of a valid notice.

5. Disclaimers and Limitation of Liability

This section is crucial. Please read it carefully.

"AS IS" SERVICE

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUYTHISFILE OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • (I) YOUR USE OF THE SERVICE;
  • (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS;
  • (III) ANY BUGS, VIRUSES, OR MALICIOUS CODE THAT MAY BE TRANSMITTED THROUGH THE SERVICE; OR
  • (IV) ANY ERRORS OR OMISSIONS IN ANY CONTENT.

LIABILITY CAP

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL COMMISSION WE RECEIVED FROM YOUR DISPUTED TRANSACTION.

6. Indemnification

You agree to defend, indemnify, and hold harmless BuyThisFile, its directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • (a) your use of the Service;
  • (b) your violation of any term of these Terms; or
  • (c) your violation of any third-party right, including without limitation any copyright or privacy right.

7. Privacy

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy at /privacy.

By using the Service, you consent to the data practices described therein.

Key Privacy Points:

  • We do not require user accounts or credentials
  • We collect minimal data: file metadata, content hashes (for abuse prevention), and server logs (7-day retention)
  • We do not track users beyond basic download counts
  • All data in transit is encrypted via HTTPS

8. Termination

We reserve the right to refuse, suspend, or terminate access to the Service for any user at any time, for any reason, without notice. This may include:

  • Blocking access from specific IP addresses
  • Blacklisting certain content hashes from being uploaded
  • Removing files that violate these Terms

Reasons for termination include, but are not limited to:

  • Suspected illegal activity
  • Violations of these Terms
  • Abuse of the Service
  • Legal requirements

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Greece, without regard to its conflict of law provisions.

For any dispute involving an EU consumer: You agree to the non-exclusive jurisdiction of the courts located in Athens, Greece.

For all other disputes: You agree that any claim or dispute must be resolved exclusively by binding arbitration in Athens, Greece.

10. General Provisions

Changes to Terms

We may modify these Terms at any time. We will provide notice of changes by:

  • Updating the "Last Updated" date at the top of this page
  • Posting the new version at /terms
  • For material changes, providing 30 days advance notice

Continued use of the Service after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BuyThisFile.

Age Requirement

You must be at least 18 years old to use this Service.
